Chapter 5: Who Runs the System: The WIPO International Bureau, the Assembly of the Madrid Union, and the Legal Framework

The Madrid System appears to be a single application form, but it actually comprises a well-structured network of specialized agencies and clearly defined legal documents. For businesses, understanding "who manages what" and "on what basis" ensures you reach the right department and contact the right person when procedural issues arise.

Three-tier Architecture: Governance, Execution, Implementation

This system operates through three interconnected layers.

The highest governing body is the Assembly of the Madrid Union. Comprising all member states, it oversees system governance by amending implementing regulations, setting fee levels, reviewing budgets, and determining major strategic directions for the system. Any substantive rule changes must be approved at this level.

The executing body is the International Bureau of WIPO, based in Geneva. It serves as the operational hub for the system: receiving international applications forwarded by offices of origin and conducting formal examination; registering them in the International Register; issuing Certificates of International Registration; publishing registration information via the WIPO International Trademark Gazette; notifying designated contracting parties of applications and relaying refusals and declarations; and processing subsequent registrations such as extensions, changes, assignments, and renewals. Think of it as the system's central mailroom and registry—but it does not conduct substantive examinations or adjudicate any substantive disputes.

The ground level consists of the competent authorities of each Contracting Party. Whether a trademark can be protected in a country is determined independently by that country's competent authority under its national law. Responses to temporary refusals, reviews, and opposition proceedings all occur domestically within each Contracting Party and require local representation; the International Bureau does not participate.

Level 4 Legal Documents: From Treaties to Domestic Law

The rules of the Madrid System are structured across four tiers, with hierarchical authority descending from top to bottom:

The first level consists of two treaties—the Madrid Agreement and the Madrid Protocol—which establish the system's core framework, including eligibility requirements, basic trademark prerequisites, examination timelines, periods of dependency and conversion, as well as validity terms and renewals.

The second tier consists of the "Implementing Regulations," adopted by the Assembly of the Madrid Union. These regulations translate the treaty's general provisions into actionable procedural rules, covering forms, time limits, fee calculations, notification methods, and more. This document is the most frequently cited in practice.

The third level consists of the Administrative Regulations, which address more technical details such as document formats and electronic communication standards, and are implemented by the International Bureau.

Level 4 comprises the domestic laws and declarations of each Contracting Party. Upon accession, each Contracting Party may make declarations regarding certain treaty provisions (e.g., a 18-month examination period, separate fees). Their domestic trademark laws determine the substantive examination standards. These differences are precisely why an international registration can have vastly different outcomes in different countries.

Practical Tips for Enterprises

First, find the right contact. For procedural issues (fees, forms, corrections, registration), reach out to the International Bureau or your original office. For substantive issues (grounds for refusal, response strategies), you must resolve them locally in the designated country; the International Bureau cannot provide advice on these matters.

Second, identify the source of the rule. When you see "Madrid Rules," determine whether they come from the treaty, the common regulations, or a declaration by a specific country. For example, whether it is 12 months or 18 months has no single answer; it depends on whether the designated country has made a 18-month declaration.

Third, monitor rule revisions. Implementing rules are updated based on Assembly resolutions; fees and forms may change. Refer to the current version on the WIPO website.

Madrid is not a black box; it's a transparent network of rules. When you know which entity manages each node and what documents govern its operation, your enterprise can truly control international trademark management.
